Terms and Conditions

Version July 2026

These terms and conditions apply to the children’s coaching programmes and parent e-consultations offered by Studio Sprout. Separate agreements, set out in writing per partnership, apply to the school programmes of Stichting Studio Sprout.

Article 1. Definitions

1.1 Studio Sprout: the trade name under which Renée van Hagen (Chamber of Commerce no. 71702911) and Davita Wopereis (Chamber of Commerce no. 95768394) each offer children’s coaching and parent sessions as independent professionals, based in Amsterdam.

1.2 Contractor: the Studio Sprout coach with whom the agreement is concluded and who carries out the programme.

1.3 Client: the parent(s) or legal guardian(s) who commission the contractor to coach the child, or the parent who books an e-consultation for themselves.

1.4 The child: the minor to whom the coaching relates.

1.5 Programme: a series of coaching sessions as agreed at the start, including the packages Sprout Start, Sprout Standard and Sprout Intensive.

1.6 Session: an individual coaching moment with the child, or an (online) conversation or e-consultation with the parent(s).

Article 2. Applicability

2.1 These terms and conditions apply to all verbal and written offers, agreements and services of Studio Sprout and to all related activities, both preparatory and executive.

2.2 These terms and conditions are referred to during the introductory or intake meeting. They are published on studiosprout.nl and sent on request.

2.3 Deviations from these terms only apply if agreed in writing between the parties. The applicability of any terms and conditions of the client is expressly rejected.

Article 3. Formation of the agreement

3.1 An agreement is formed when the client agrees, verbally or in writing (including by e-mail or via the booking form on the website), to the proposed programme or e-consultation and the corresponding rates.

3.2 Every programme is preceded by an introductory meeting. This meeting is free of charge and without obligation.

3.3 Rates stated in an agreement do not automatically apply to future assignments. Rate changes are announced at least one month in advance and do not apply to programmes already agreed.

Article 4. Consent of parents with legal custody

4.1 For the coaching of children under 16, both parents or legal guardians with custody must, where applicable, agree to the coaching.

4.2 The commissioning parent ensures that any other parent with custody is fully and correctly informed about the coaching and gives their consent. The commissioning parent accepts that, should the other parent with custody object to the coaching in any way, they bear the consequences. The contractor cannot accept responsibility for this.

4.3 In the case of divorced parents, the contractor may request written consent from both parents with custody before the programme starts.

Article 5. Performance of the services

5.1 The contractor carries out the coaching to the best of their insight, expertise and ability. This constitutes an obligation of effort, not of result: the contractor cannot guarantee the outcome of the programme.

5.2 Children’s coaching is a form of guidance and not a (medical) treatment, therapy or diagnostics. The contractor does not make diagnoses. Coaching is not intended as a substitute for medical or psychological care.

5.3 If during the programme it becomes apparent that the child’s needs fall outside the contractor’s expertise or that more serious issues come to light, the contractor discusses this with the parents and, where possible, refers to appropriate care (for example a general practitioner, youth team or mental health services).

5.4 Parents remain responsible at all times for decisions regarding the upbringing, care and (medical) treatment of their child. Advice from the contractor is not binding; following it is at the parents’ own responsibility.

5.5 The approach is tailored to the child. The contractor determines, in consultation with parents and child, which methods are used.

5.6 Bringing the child to and collecting the child from the practice space is the responsibility of the parents. Parents ensure they can be reached by phone during the session.

Article 6. Rates and payment

6.1 Current rates are published on studiosprout.nl. All rates for private clients include VAT unless stated otherwise.

6.2 Invoicing takes place per programme or per session, as agreed at the start. Payment is due within 14 days of the invoice date to the account number stated on the invoice.

6.3 In the event of late payment, the client receives a payment reminder with a 14 day term. If payment is still not made, the contractor is entitled to charge statutory interest and reasonable (extrajudicial) collection costs in accordance with Dutch law on collection costs.

6.4 As long as invoices remain unpaid, the contractor may suspend the services. Scheduled sessions may in that case be postponed until payment has been made.

6.5 Children’s coaching is generally not reimbursed by health insurers. The client is responsible for checking any reimbursement options.

Article 7. Cancellation and rescheduling

7.1 A scheduled session can be cancelled or rescheduled free of charge up to 24 hours before it starts, by phone, e-mail or WhatsApp.

7.2 In case of cancellation within 24 hours of the start, or failure to appear without notice, the reserved time is charged in full.

7.3 If the child is ill, a new appointment is arranged in consultation; in that case no costs are charged, provided the cancellation is communicated before the start of the session.

7.4 If the contractor is unavailable or ill, the session is rescheduled free of charge. The client is not entitled to compensation in that case.

Article 8. Early termination

8.1 Both the client and the contractor may terminate the agreement early if continuation is reasonably no longer useful or desirable. This preferably takes place after a joint conversation.

8.2 In case of early termination of a programme, the sessions already held and the intake meeting are settled at the individual session rate. Any overpaid amount is refunded within 14 days.

8.3 The contractor may terminate the agreement with immediate effect if the client fails to meet obligations under the agreement or these terms, or if the basis of trust required for the coaching has ceased to exist.

Article 9. Right of withdrawal for distance purchases

9.1 If the client, acting as a consumer, purchases a service (such as an e-consultation or programme) online or at a distance, a statutory cooling-off period of 14 days applies during which the agreement may be withdrawn without giving reasons.

9.2 If the client wishes the services to start within the cooling-off period, the client expressly agrees when booking that the right of withdrawal lapses once the service has been fully performed, and that in case of withdrawal after partial performance a proportionate part of the price is due.

Article 10. Confidentiality, records and the reporting code

10.1 Everything discussed between the contractor, the child and the parents is treated confidentially. The contractor does not share information with third parties without the parents’ consent, except where a legal obligation exists.

10.2 In the child’s interest, the contractor reports progress to the parents in broad terms. What the child shares in confidence is only shared if this is in the child’s interest and preferably in consultation with the child.

10.3 The contractor keeps a file for each child containing the intake details, session notes and progress. The Studio Sprout privacy statement applies to this file. Parents have the right to inspect their child’s file.

10.4 The contractor works in accordance with the Dutch reporting code for domestic violence and child abuse (Meldcode huiselijk geweld en kindermishandeling). In case of serious concerns about the child’s safety, the contractor may, preferably after consulting the parents, follow the steps of the reporting code. This may mean the contractor seeks advice from or files a report with Veilig Thuis, if necessary without the parents’ consent where the situation so requires.

Article 11. Contact with third parties and written reports

11.1 At the parents’ request, the contractor may liaise with third parties, such as the child’s school, for observation or alignment. The time spent is charged at the applicable hourly rate, plus any travel costs.

11.2 At the parents’ request, the contractor may prepare a written report for third parties. The time spent is charged. Reports are only shared with the parents’ written consent.

Article 12. Liability

12.1 The contractor is only liable for direct damage resulting from an attributable shortcoming in the performance of the agreement.

12.2 Any liability of the contractor is limited to the amount invoiced for the agreement concerned, or the amount paid out by the professional or business liability insurance in the case concerned.

12.3 The contractor is not liable for indirect or consequential damage, nor for damage resulting from incorrect or incomplete information provided by the client.

12.4 The contractor is not liable for decisions made by parents or third parties on the basis of the coaching or the contractor’s advice.

12.5 Any claim for compensation lapses if it is not reported to the contractor in writing within one year of the damage arising.

Article 13. Complaints

13.1 In case of dissatisfaction with the services, the client first contacts the contractor so that a solution can be sought together. Complaints can be submitted in writing via studiosprout.amst@gmail.com and receive a substantive response within 14 days.

13.2 A complaint does not suspend the client’s payment obligation.

Article 14. Applicable law and disputes

14.1 Dutch law applies to all agreements between the client and the contractor.

14.2 The parties will only turn to a court after having made every effort to resolve the dispute by mutual agreement.

14.3 Disputes are submitted to the competent court of the District Court of Amsterdam, unless mandatory law provides otherwise.

Article 15. Changes

15.1 Studio Sprout may amend these terms and conditions. The most recent version is published on studiosprout.nl. For ongoing programmes, the version that applied at the start of the programme remains in force, unless a change is more favourable to the client.
